Terms and Conditions of Sale — Travellers

ART. 1 Subject

These General Terms and Conditions of Sale (GTC) govern the terms on which AD Aura Serenity & Co (SAS, RCS Nice 102 462 116, 455 Promenade des Anglais, 06200 Nice) provides booking and concierge services to travellers staying in the accommodation it manages on the Côte d’Azur.

The properties on offer are registered in accordance with current regulations. For the property Sea la vie (185 Boulevard de la Madeleine, Building C, 06000 Nice), the registration number with the town hall is: 06088041505DP.

Any booking made implies full and unconditional acceptance of these Terms and Conditions of Sale, as well as the house rules specific to the accommodation booked.

ART. 2 Booking and payment

Bookings can be made via the following channels: the Conciergerie’s official website (adauraserenity-conciergerie.com) via a secure online booking engine (Smoobu), partner platforms (Airbnb, Booking.com) or by contacting the team directly.

Any confirmed booking constitutes acceptance of these Terms and Conditions and the house rules for the accommodation.

Payments are processed securely via Stripe Connect (credit card, Apple Pay). AD Aura Serenity & Co does not collect, hold or handle travellers’ funds in any way, apart from the commissions and service charges due to it.

2.1 Service charges

For direct bookings made via the website, a service charge of 6.67% excluding VAT (i.e. 8% including VAT, at 20%) are applied to the total cost of the overnight stays. These charges cover operational coordination, 7-day-a-week support and concierge services.

2.2 Cleaning costs

A flat-rate cleaning fee is charged for each booking. The amount is shown at the time of booking, depending on the accommodation in question. For the accommodation Sea la vie In Nice, cleaning charges are €115 incl. VAT.

2.3 Tourist tax

A tourist tax is levied in accordance with the regulations in force in the local authority area. The amount is stated at the time of booking and is added to the cost of the accommodation.

2.4 Optional services

Additional services can be booked at the time of booking or during your stay, including:

  • Early check-in (arrival before 3.00 pm) — €40 including VAT, subject to availability
  • Late check-out (departure after 11.00) — €40 including VAT, subject to availability
  • Romantic experiences & birthday celebrations, beach equipment, baby facilities, grocery delivery, mid-stay cleaning, airport/station transfers

The team will confirm the availability of early check-in and late check-out after booking. No refund will be given if the service cannot be provided due to unavailability.

ART. 3 Check-in and check-out times

Guests are asked to let us know their estimated time of arrival the day before their stay so that the team can make the necessary arrangements.

Any late check-out not agreed in advance may result in an additional charge equivalent to one full night’s stay.

ART. 4 Cancellation Policy

In accordance with Article L221-28(12) of the Consumer Code, accommodation bookings for specific dates are not covered by the statutory 14-day right of withdrawal.

The applicable cancellation terms are those set out at the time of booking on the platform used. In the case of a direct booking via the Conciergerie’s website:

Service charges, cleaning fees and optional services that have already been paid are non-refundable in the event of cancellation.

ART. 5 Passenger obligations

5.1 Maximum capacity

The guest undertakes to comply with the maximum occupancy limit for the accommodation. The presence of any additional, undeclared guests (even on a temporary basis) is prohibited without prior written consent. Should it be found that this limit has been exceeded, the Conciergerie reserves the right to refuse access to any additional guests or to terminate the stay immediately without refund. A fixed compensation payment of €150 (including VAT) per night per additional guest will be applied (the absolute minimum of €500 (including VAT)), deducted from the security deposit or via a payment link.

5.2 Noise nuisance

The traveller undertakes to behave in a responsible and respectful manner. Noise nuisance is strictly prohibited, particularly between 10.00 pm and 8.00 am. In the event of a complaint from neighbours or the property manager regarding noise, the tenancy may be terminated immediately and without refund.

5.3 No smoking

The inside of the property is strictly non-smoker. Smoking is permitted only on balconies, provided that the French windows are kept closed and an ashtray is used. Any breach of this rule will result in a fixed charge for cleaning and deodorising €200 (including VAT).

5.4 Energy savings and safety

The guest undertakes to switch off energy-consuming appliances (air conditioning, heating) whilst away, to lock the doors and windows when leaving the premises, and to report any faults to the staff immediately.

5.5 Celebrations and gatherings

No party or gathering may be organised without the prior written consent of the Conciergerie.

5.6 Pets

Pets are not permitted, unless explicitly stated otherwise in the listing for the property in question.

5.7 Departure — inventory

At the start of the journey, the passenger is required to:

  • Leaving the property before 11.00 am (unless a late check-out has been agreed)
  • Empty the bins (including outdoor ashtrays) and place them in the bins provided for this purpose
  • Empty the dishwasher, wash the crockery and put it away in the cupboards
  • Please return the keys as instructed (to the secure box or left inside the property)
  • Make sure the property is properly locked

In the absence of a joint inventory, any damage found after the occupant has left will be charged to the last occupant.

5.8 Security deposit

A security deposit may be required, depending on the accommodation and the length of stay. The amount will be specified at the time of booking. It will be refunded within 7 days after departure, less the cost of any necessary repairs or replacements. Any damage may be charged via the platforms’ procedures or via Stripe.

5.9 Record form

In accordance with French regulations, foreign nationals are required to complete a registration form (police registration form) prior to their arrival. A personalised link will be provided upon booking confirmation. A copy of your identity document (passport or national identity card) must be sent to the team before check-in.

5.10 Travel insurance

Travellers are strongly advised to take out cancellation insurance and holiday insurance covering any damage that may be caused to the rented property. AD Aura Serenity & Co cannot be held liable in the absence of such cover.

ART. 6 Services included

  • Personalised welcome (in person or self-service, depending on the organisation) with access details provided the day before arrival

  • Clean and fully equipped accommodation (linen, basic essentials)
  • Digital welcome booklet provided upon confirmation (practical information, access, facilities, recommendations)
  • Access information sent the day before your stay (transport, parking, access codes)

ART. 7 Liability

AD Aura Serenity & Co acts as an operational service provider and service coordinator. Its liability is limited to faults directly attributable to the services it provides.

The property owner remains solely responsible for the property’s compliance with regulations, its fitness for habitation and its general condition. The concierge service cannot be held liable for hidden defects, equipment malfunctions or decisions made by booking platforms.

In the event of force majeure or exceptional circumstances rendering the accommodation unavailable, the Conciergerie undertakes to offer an alternative solution or to refund the full amount paid.

ART. 8 Data Protection (GDPR)

Travellers’ personal data is processed in accordance with the General Data Protection Regulation (GDPR), solely for the purposes of managing their stay (booking, communication, invoicing, legal obligations). It is not sold on to third parties.

The data collected includes, in particular: surname, first name, contact details, identity document (for police records), and payment details (processed exclusively by Stripe).

ART. 9 Mediation and Disputes

In the event of a dispute that cannot be resolved amicably, the traveller may refer the matter to the consumer ombudsman free of charge:
